Acceptable Use Policy
1. Scope
This Acceptable Use Policy (“AUP”) applies to everyone who uses Fruity (“you”) and to all content, conduct, and activity on or through the Service. It is incorporated into our Terms of Service. Capitalized terms have the meaning given in the Terms.
2. Prohibited Content
You may not post, upload, link to, or otherwise share content that:
- is unlawful, fraudulent, deceptive, defamatory, libelous, obscene, vulgar, profane, or otherwise objectionable;
- sexually exploits or endangers minors in any way (including child sexual abuse material — “CSAM”), or is sexually suggestive of minors;
- depicts non-consensual sexual content or so-called “revenge porn”;
- incites, promotes, or glorifies violence, terrorism, mass harm, self-harm, suicide, or eating disorders;
- promotes hatred, harassment, or discrimination against individuals or groups based on race, ethnicity, national origin, religion, disability, gender, gender identity, sexual orientation, age, veteran status, or serious disease;
- contains personally identifiable information of others without their consent (“doxxing”);
- infringes any third party's copyright, trademark, trade secret, patent, publicity, privacy, or other proprietary right;
- contains malware, ransomware, spyware, viruses, worms, trojans, keyloggers, rootkits, drive-by downloads, or any other malicious code;
- links to phishing sites, scams, fake login pages, or sites impersonating others;
- promotes illegal goods or services, including controlled substances, weapons, counterfeit items, or stolen goods;
- promotes pyramid schemes, multi-level marketing fraud, “get rich quick” scams, or unregistered securities offerings;
- contains explicit pornography where such content is restricted by our policies or by the laws of the regions where the Service is accessed.
3. Prohibited Conduct
You may not, and may not assist or permit anyone else to:
- access, tamper with, or use non-public areas of the Service, our systems, or the technical delivery systems of our providers;
- probe, scan, or test the vulnerability of any system or network;
- breach or circumvent any security or authentication measure, rate limit, or access control;
- forge, spoof, or alter any TCP/IP packet header, email header, or part of any message;
- interfere with or disrupt the integrity or performance of the Service or the data it contains, including by launching a denial of service attack or sending excessive automated traffic;
- plan or engage in illegal activity or violate any law, regulation, or third-party agreement;
- engage in spamming, scraping, harvesting, indexing, framing, or any high-volume automated activity that is not authorized in writing by Fruity;
- create accounts by automated means, sell, transfer, or buy accounts or aliases;
- impersonate any person or entity, including any employee or representative of Fruity, or misrepresent your affiliation;
- use the Service to evade any block, ban, or restriction we have put in place;
- use the Service to track or harvest personal data about visitors to your bio page beyond what is disclosed in our Privacy Policy;
- attempt to decompile, reverse engineer, or otherwise derive the source code of the Service except where permitted by law;
- remove, obscure, or alter any proprietary notice, trademark, or branding on the Service;
- use the Service in any way that, in our sole judgment, exposes us or our users to harm, liability, or reputational risk.
4. Enforcement
We are not obligated to monitor the Service, but we may investigate any suspected violation of this AUP. Where we determine, in our sole discretion, that a violation has occurred, we may take any action that we deem appropriate, including but not limited to:
- removing or restricting access to content;
- limiting features, throttling, or rate-limiting your account;
- warning you or requiring you to remediate;
- suspending or terminating your account, with or without notice;
- reclaiming any alias or vanity URL associated with the violation;
- reporting illegal activity to law enforcement or other authorities;
- pursuing civil or criminal remedies and recovering costs and attorneys' fees.
Decisions made under this policy are made in our sole discretion and are final.
5. Reporting Violations
If you become aware of a violation of this AUP, please report it to [email protected]. For copyright infringement, follow the process in our DMCA / Copyright Policy. For child safety concerns, please mark your email “URGENT — CHILD SAFETY” and provide as much detail as possible.
6. Changes to This Policy
We may update this AUP from time to time. The “Last updated” date above indicates the most recent version. Continued use of the Service after changes constitutes acceptance of the updated AUP.
